Report a Privacy Incident

PRIVACY INCIDENT REPORTING

It is the policy of The Baker Center to allow individuals to express concerns and complaints regarding The Baker Center’s Privacy Policies or Procedures or privacy practices and to respond to such concerns and complaints in a timely and appropriate manner. 

1.  Accepting Complaints. Individuals who express concerns or complaints about The Baker Center’s Privacy Policies or Procedures, or privacy practices, will be assured that The Baker Center takes their concerns very seriously and intends to address the issue promptly and appropriately. 

a. Baker Center Workforce Members: If the individual wishes to file a complaint regarding The Baker Center’s Privacy Policies or Procedures or privacy practices, the Baker Center Workforce member who receives the complaint will: 

i. Access and complete the privacy incident report form located on The Baker Center website and submit the form to the Compliance Officer and Information Privacy & Security/Health Insurance Portability and Accountability Act (IPS/HIPAA) Committee Chair*, or  

ii. If preferred by the individual, direct them to instructions on how to file a complaint in The Baker Center’s Notice of Privacy Practices.

b. Individuals: To file a complaint, please complete the Privacy Incident Form via the link at the bottom of this web page. Submit the completed form to the Compliance Officer and IPS/HIPAA Committee Chair*

c. Individuals with concerns or complaints regarding The Baker Center’s Privacy Policies or Procedures or privacy practices will have the right to speak directly with the Compliance Officer and IPS/HIPAA Committee Chair* or designee. 

d. The individual is entitled to complain directly to the Office for Civil Rights (OCR) and will be provided, upon request, the address and telephone number of the official or agency designated by OCR to receive such complaints. 

2. Investigation. The Compliance Officer and the IPS/HIPAA Committee will promptly investigate any privacy-related complaint.

3. Resolving the Privacy-Related Complaint. If the complaint is justified, The Baker Center will take prompt action to ensure that similar problems do not arise in the future.  

a. Appropriate responses may range from changing certain practices, policies, and procedures, providing additional Workforce training, or taking necessary disciplinary action.  

b. If the investigation of the complaint results in a determination that PHI has been improperly disclosed, the Compliance Officer will coordinate an appropriate response.

4. Notice to Persons Who Complained. Once the matter is resolved, the Compliance Officer, in consultation with legal counsel, may respond to the individual who submitted the complaint.
